How can businesses prevent infringing third parties’ industrial designs?
Industrial designs are not screened for possible violation of third parties’ rights before the decision to grant protection is issued. If an entrepreneur wishes to know whether the industrial design he or she developed infringes the rights of other businesses, they can refer to publicly available databases of the Polish Patent Office and foreign organizations providing registration of industrial designs (WIPO, OHIM). A more detailed examination can be carried out by a patent advisor using paid databases and evaluation criteria developed together with the client.
