Applying for industrial design protection in Poland

To obtain protection for an industrial design in Poland, it is necessary to file an application with the Patent Office of the Republic of Poland. The application must contain an illustration of the design together with its description. The requirements pertaining to an industrial design are novelty and individual character. However, the Office does not verify whether or not the design contains those qualities and only examines the formal correctness of the application, which lasts about one month. If the application is found to meet the formal requirements, the Office will issue a conditional decision to grant registration and publish it in its official Bulletin. For a period of six months following the publication anyone may file an opposition to that design.

Protection of an industrial design is granted for a maximum of 25 years.
