11:20 – 13:30 – EXPERT PANEL: “Software – how to protect it effectively to have a monopoly? Discussion with several attending patent attorneys about strategy, opportunities and risks.”

Undertaking IT projects involves the need to prepare and implement an effective strategy for protecting intellectual property both in companies and research centers. During the panel, divided into two parts, our experts will talk to representatives of both groups and present the most common problems, traps and opportunities that arise in the field of intellectual property protection when undertaking IT projects.

The discussion between patent attorneys and representatives of Polish universities and businesses will be based on real case studies, which will make it possible to present the issues practically. The discussion will focus on the possibilities of obtaining exclusive protection for computer programs and will be set in the context of copyright protection and computer-assisted inventions.  

The panel will address a range of topics, including:

  • How can software be protected?
  • What problems do creators face in protecting computer-assisted inventions?
  • What are the most frequently identified intellectual property protection issues confronted by entrepreneurs when undertaking ICT projects?
  • Can a protection of the solution by know-how be considered an alternative to patent protection, and to what extent?
  • When deciding on the protection path for an object (invention, work), is its commercial potential considered?
  • What does cooperation between universities and the industry look like?

Tomasz Poczęsny

Technology Transfer Specialist, Head of the Intellectual Property Protection Department at the Centre for Innovation and Technology Transfer Management, Warsaw University of Technology

A graduate of the Faculty of Physics at the Warsaw University of Technology in the field of optoelectronics. Until 2012 participated in research and development projects carried out together with the industry. Since 2013 involved in improving processes of technology transfer and intellectual property protection at the University, as well as in supporting scientific entrepreneurship.
He assisted in establishing more than 20 spin-off companies, firstly on behalf of the special-purpose vehicle of the University, being the Applied Research Institute – Warsaw Institute of Technology, and now on behalf of the Centre for Innovation and Technology Transfer Management of the Warsaw University of Technology. For many years cooperating with patent attorneys and scientists to strengthen the role of intellectual property in broadly defined commercialization of scientific research results.

Łukasz Szczygielski

Coordinator of European projects, Wicomm R&D Centre, Gdansk University of Technology

For many years he has been coordinating the implementation of tasks in international research and development projects, such as INSECTT, SCOTT, AFARCLOUD, BEYOND5 or DEWI. The recipients of devices and systems designed in these projects are leading European companies, such as Airbus, as well as domestic entities, such as Port of Gdansk or Gdansk Lech Walesa Airport.
He is a graduate of the Gdansk University of Technology, Faculty of Management and Economics, and the author and co-author of publications. With his experience gained during his work for IBM and Atena he perfectly understands the needs of the business world.

Rafał Kukliński

Managing Director of the Amazon Development Center in Poland

Rafal Kuklinski is a Director at Amazon leading the Text-to-Speech technology team and the Managing Director of the Amazon Development Center in Poland. Rafal has been with Amazon for 9 years working on speech synthesis systems that power a wide range of Amazon products and services, including Amazon Fire tablets, Kindle Readers, Amazon Alexa and an AWS TTS service Amazon Polly.
He works on application of Deep Learning and signal processing techniques for prosody modeling of Speech Synthesis and Natural Language Processing. Prior to Amazon, Rafal held a variety of technical and leadership positions at companies such as General Electric and Lufthansa, working on technologies ranging from flight planning systems to video compression and analysis systems.

10:00 – 11:30 – EXPERT PANEL: “Role and responsibility of service providers providing their services electronically on the digital single market.”

In times of increasing demand for online transactions and services, and of ongoing EU reforms in digital services and markets, transparent, balanced rules on the protection of intellectual property on the Internet and on liability for infringement of said property are becoming essential.

The panel with experts representing Internet intermediaries, practitioners and academics will provide an excellent opportunity to discuss regulatory changes to the rules on liability of service providers providing their services electronically, i.e. whether and in what direction these changes should go, so that they meet the interests of intellectual property rights owners, the business models of Internet intermediaries and the needs of consumers.

The panel will address a range of issues, including:

  • Are online platforms liable for intellectual property rights infringements?
  • What changes do the EU digital market reforms bring for online platforms in terms of intellectual property rights protection?
  • What “best practices” are there on the digital market for reporting and preventing infringements ?
  • Can courts order blocking access to sales platforms when infringements are found?

The Intellectual Property Law Chair of the Jagiellonian University in Krakow.

Justyna Ozegalska-Trybalska is an Associate Professor (Doctor Habilitatus) at the Intellectual Property Law Chair of the Jagiellonian University. She teaches Internet law, intellectual property law and patent law at Jagiellonian University, Tongji University in Shanghai, Technical University of Dresden. As a visiting scholar, she researched at the Columbia University School of Law in New York (2003) and the Max Planck Institute for Innovation and Competition in Munich (2017).
She is an arbitrator at the Domain Name Court at the Polish Chamber of Informatics and Telecommunication and WIPO Arbitration and Mediation Centre; senior expert in international projects and coordinator of the Joint Master's Degree Programme in Intellectual Property and New Technologies organized by Jagiellonian University, World Intellectual Property Organization and the Polish Patent Office. Justyna Ożegalska-Trybalska is the author (co-author) of over 70 national and foreign publications, including a monograph (Domain Name – legal issues, 2003); chapters in the books and articles focused on intellectual property, new technologies, IP management and technology transfer.

She specializes in intellectual property law and regulations concerning liability of intermediaries. On an everyday basis, she manages a team focused on the Rights Protection Cooperation Program, which supports the enforcement of exclusive rights of entities that report infringements, and activities related to the management of company’s trademark portfolio. A member of the Expert Group at EUIPO Observatory. She completed postgraduate studies in Intellectual Property Law at the Faculty of Law and Administration of the University of Warsaw and the School of English and European Law organized by the University of Cambridge (British Law Centre).

Cezary Sowiński

Amazon

He is an expert in the legal and tax aspects of trading goods and related issues, successfully combining his solid academic foundation with extensive practical knowledge and experience in the field of VAT, excise, customs, trade compliance and trade facilitation in various business applications around the world. He is currently working at Amazon, delving deeply into the broader world of Public Policy in Poland and dealing with regulatory changes, especially in the areas of customs and tax law, product safety, consumer and competition law.
Before Amazon, he was a Senior Director of Customs and Regulatory Affairs Europe at DHL Express and a manager in the Indirect Tax Team at PricewaterhouseCoopers Poland and in the Polish Ministry of Economy. He graduated from Cracow University of Economics and the University of Southern Denmark (both with master’s degree), and then was awarded a doctoral degree at the Warsaw School of Economics. He is a certified tax advisor.
